General terms and conditions of business,

Conditions of carriage and cancellation fees

 

1. Contractual partners are the operating airline and the respective client and passenger. In individual cases, the air carrier named as the contractual partner can use another air carrier that fulfills the same legal requirements of the BMVIT to carry out the journey. In this case, the aviation company used assumes liability. If the flight is transferred to another airline, the passenger has the option to withdraw from the contract. The passenger cannot therefore assert claims for damages.

2. The carrier's liability is limited under existing aviation laws.

3. There is no liability for luggage, photo and film equipment. If you take your luggage with you, you are responsible for shock-proof storage during the entire journey. The passenger is also responsible for ensuring that other passengers are not harmed by their luggage, photo or film equipment.

4. The passenger is responsible for arriving on time at the meeting point or starting point. Failure to show up or late cancellation (at least 48 hours before departure) due to reasons for which the guest is responsible will result in the loss of the fare paid without replacement.

5. Passengers can be taken along when changing the starting point and the return trip to the starting point by car is free of charge.

6. The invoice amount for the balloon flight is due by "bank account transfer" (in advance), cash payment in the office (in advance) or "cash payment on site" without deductions. The air carrier may refuse carriage and appointment if the full fare is not paid.

7. Failure to observe the “Special Rules and Behavior for Balloon Flights” can lead to exclusion from the flight.

8. Carriage can also be refused if there is a suspicion of alcohol consumption before the journey.

9. Damage and injuries must be reported to the pilot/air carrier immediately, at the latest within two calendar days after the flight has taken place.

10. Agreed dates are binding and can only be changed with our consent up to 48 hours before the start of the journey. If you change to a new date, you will not incur any costs, but there is no right to immediate fulfillment of your suggested date.

11. The tickets issued are valid for 3 years from the date of issue. In the case of price increases 4 months or more after the date of issue, the difference must be settled before the start. The fares valid according to the current brochure apply, special regulations in individual cases must be in writing. Offers sent or submitted by alpineballooning – austria/tirol by email or verbally are valid for a maximum of 4 months!

12. Amounts paid are non-refundable, a cash replacement of the tickets is excluded. The ticket(s) issued by name are non-transferrable. Name changes can only be made by issuing a new ticket and are subject to a processing fee of EUR 20.00. Cancellations for legitimate reasons can only be made with the agreement of the air carrier. In the case of cancellations, we charge 20% of the ticket price per person for registration, telephone and administration costs. If tickets, vouchers or tickets that were brokered through agencies (Jollydays, Jochen Schweizer, Mydays, Pro Alps, Gift Idea at, etc.) are cancelled, the brokerage fee to these agencies applies as a cancellation fee.

13. Claims for damages due to weather-related or technical cancellations at the starting point are excluded.

14. The prices apply to the balloon ride, personal certificate, persons and property insurance. The passenger makes a departure appointment with the airline. If the start date is postponed for any reason, eg due to weather conditions, a new date must be agreed. If possible, an alternative date should be specified at the time of booking. If this date is also postponed - the responsibility for this lies solely with the air carrier - another appointment will be made.

15. The air carrier tries to give you information about the execution of the journey. The allocation of seats in the balloon and the selection of the respective balloon type is the responsibility of the air carrier.

16. The agreed travel times according to the current tariff table are approximate times. Depending on the weather situation and the available landing area. Since the balloon is driven by the wind, the air carrier can shorten the journey time in the interest of safety for people and equipment. The minimum journey time is 60 minutes. If the agreed travel time is less than 15 minutes, the operating airline will credit the time as a percentage of the fare for further journeys. These tickets are not transferrable. A cash replacement of the tickets is excluded. If, for reasons beyond the control of the air carrier, a shorter journey time is required, the journey is deemed to have been carried out in accordance with the contract.

17. Place of performance and place of jurisdiction for all claims and legal disputes arising from the contractual relationship is the registered office of the airline.

18. Alpineballooning – austria/tirol reserves the right to cancel a booked “little alpine trip” and to postpone it to the next possible date due to a sponsorship or an Alpine crossing!!

Up to 7 days before the agreed date – no cancellation costs
Up to 2 days before the planned date – 50% cancellation fee
Up to 1 day before the planned date – 80% cancellation fee
Failure to show up at the agreed meeting point - 100% cancellation fee

You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day the contract was concluded.
In order to exercise your right of cancellation, you must send us (alpineballooning – austria/tirol, Josef-Wilberger-Straße 10, 6020 Innsbruck, +43 (0)650 5647759, info@alpineballooning.at) a clear statement (e.g. a letter sent by post or e-mail) about your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

 

Consequences of revocation

 

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you. Under no circumstances will you be charged any fees for this repayment.

If you have requested that the services should begin during the cancellation period, you must pay us a reasonable amount that corresponds to the proportion of the services already provided up to the point in time at which you informed us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.

Conditions of Carriage:

Carriage and all other services based on this balloon ticket are subject to

a) the liability regulation of the Warsaw Convention applicable to commercial air traffic in the version of the Hague Protocol, the Montreal Convention and EU Regulation 1008/2008, EU Regulation 2027/1997 and EU Regulation 785/2004 (in the currently valid version )  with the statutory maximum liability amounts for commercial passenger transport in Austria, b) the general provisions of the conditions of carriage of the company alpineballooning - austria/tirol, Andreas Nairz, Josef-Wilberger-Straße 10, A- 6020 Innsbruck , c) the applicable tariffs and d) the conditions specified in this balloon ticket. The following insurances have been taken out for balloon passengers with valid balloon tickets:
1) Passenger liability insurance based on statutory provisions up to SDR 300,000.00 in the event of the death or injury of a passenger, and up to SDR 1,000.00 for luggage in custody.
2) Air passenger accident insurance in the event of death and permanent disability in accordance with the General Conditions for Aviation Accident Insurance (ALUB) with an insured sum of up to €40,000.00 per passenger seat.
We are not liable for fragile and perishable items. It is forbidden to take explosive or fire-endangered, radioactive objects with you. In addition, any liability is excluded.
The company alpineballooning – austria/tirol, Andreas Nairz, Josef-Wilberger-Strasse 10, A-6020 Innsbruck, is not liable for damage resulting from the observance of applicable legal and flight regulations, official regulations or instructions or from contributory negligence on the part of the balloon passenger and nor for damage that occurs on the way to and from the balloon ride.

The balloon passenger himself must fulfill all officially stipulated travel formalities and present all necessary exit, entry and other documents.

Up to 0 days: 100% cancellation fee

No Show: 100% cancellation fee
